Terms of Service

Last updated: September 14, 2026

1. Acceptance of Terms

By creating an account or using WayCap ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. If you are accepting these terms on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. The Service

WayCap lets a host create a time-bounded "happening" (an event window) and lets attendees with the invite code or link capture photos and short videos into a shared pool. The host can configure the start and end time, allowed media types, maximum video length, and whether location is tagged. Hosts may moderate their events by deleting captures or removing members.

WayCap is provided on iOS, Android, and the web. Some features, including the AI-edited recap, may not yet be available in your region or on your platform.

3. User Content & License

You retain ownership of the photos and videos you capture in WayCap. By uploading content to a happening, you grant WayCap a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process that content for the purpose of operating the Service — including displaying it to other members of the same happening, generating recaps, and providing downloads to the uploader.

Captures within a happening are visible to other members of that happening. Do not capture media into a happening that you do not have the right to share, or that you would not want other attendees to see.

4. Prohibited Conduct

You agree not to use WayCap to capture, upload, or share content that is illegal, that infringes the rights of others, that depicts non-consenting individuals in intimate or private contexts, or that is intended to harass, threaten, or impersonate any person. You agree not to attempt to access happenings you were not invited to, reverse-engineer the Service, or interfere with its operation or security.

Hosts are responsible for the content within their happenings. WayCap may remove content or terminate accounts that violate these terms.

5. AI Processing

WayCap offers AI-assisted features, including recap video generation, that process captures server-side. AI processing happens only within the context of an opted-in happening, on media you have uploaded or that other members of the happening have uploaded. You can opt out of AI processing for a happening by not generating a recap, or by contacting us to request deletion of generated outputs.

6. Accounts & Termination

You are responsible for your account credentials and for activity that occurs under your account. You may delete your account at any time from the app, which will delete your profile and remove your membership from active happenings. Captures you uploaded to other members' happenings may remain unless the host also deletes them.

We may suspend or terminate accounts that violate these terms or pose a safety concern, with or without notice.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. WayCap does not warrant that the Service will be uninterrupted, secure, or error-free, or that captures will not be lost.

8. Limitation of Liability

To the maximum extent permitted by law, WayCap and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Where liability cannot be excluded, it is limited to the amount you have paid WayCap in the twelve months preceding the claim.

9. Governing Law & Disputes

These terms are governed by the laws of the jurisdiction in which WayCap's operating entity is established, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the courts of that jurisdiction, unless mandatory consumer-protection law gives you the right to bring claims in your country of residence.

10. Changes to these Terms

We may update these terms from time to time. If a change is material, we will give you reasonable notice — for example, by emailing the address on your account or by surfacing a notice in the app. The "Last updated" date at the top of this page will reflect the current version. Continued use of the Service after a change takes effect constitutes acceptance of the new terms.
